In most divorce cases, a judge will use the NC alimony calculator to
determine the proper amount awarded to a spouse that makes less money, or who
is responsible for minor children. In the state of North Carolina, either party
is entitled to seek alimony. Alimony is usually ordered to be paid to spouses
who are not financially able to support themselves, providing their spouses are
able to provide some level of support them. A judge also considers mitigating
factors such as marital misconduct, adultery, or cruelty. They can be used as a
reason increase or to limit alimony payments. However, the courts cannot use
misconduct as a reason to deny alimony unless they find evidence of adultery.
Modifying alimony
- The courts can modify or adjust alimony whenever one of the spouses can demonstrate a substantial change in circumstances.
