A divorce judge will use a NC alimony calculator to determine the amount for the spouse that makes less money, or who is responsible for minor children. In North Carolina, either party may seek alimony. The courts will typically order alimony to be paid to spouses who are not financially able to support themselves, and whose spouses can afford to support them. A judge may also consider mitigating factors such as marital misconduct, including adultery or cruelty. They can be used as a reason to limit alimony payments. Courts can use fault as a reason to lower a spouse's alimony payment, but they cannot use misconduct as a reason to deny alimony unless they find evidence of adultery.
