Seeking alimony
A divorce judge will use a NC alimony calculator to determine the
amount for the spouse that makes less money, or who is responsible for minor
children. In North Carolina, either party may seek alimony. The courts will
typically order alimony to be paid to spouses who are not financially able to
support themselves, and whose spouses can afford to support them. A judge may also
consider mitigating factors such as marital misconduct, including adultery or
cruelty. They can be used as a reason to limit alimony payments. Courts can use
fault as a reason to lower a spouse's alimony payment, but they cannot use
misconduct as a reason to deny alimony unless they find evidence of adultery.
Modifying alimony
- The courts can modify or adjust alimony whenever one of the spouses demonstrate a significant change in circumstances.
- A significant change in circumstances can include loss or change in employment, unexpected medical needs, a change in financial needs of the minor children.
- If either party desires modification, they must petition the court. It will be up to the requesting party to face the burden of proof.
- North Carolina does not award alimony to civil partners and common law spouses.
